Moved the Commission adopt the general
guidelines for treating producers
similarly to how the cooperatives and
handlers treat them as payroll entities;
and
Authorize the Committee on Regulations
and Rulemaking to evaluate particular
cases upon referral from the staff and
to make exceptions to the general
guideline for unusual circumstances
based on fairness. Members of the
Committee who are eligible for a refund
under the program will not participate
in this process. Members will recuse
themselves from consideration of
application claims from their states.
